Goldman\, Executive Director\, Center of Law and Security\nKatherine J. Strandburg\, Alfred B. Engelberg Professor of Law\n\nMore than ever before\, people today rely on cloud computing services for email\, online storage and backup\, social media\, video services\, and gaming. However\, the laws governing data privacy obligations were written long before anyone dreamed up the cloud. This makes regulatory issues very complicated at the purely domestic level\, but even more so when cross-jurisdictional issues come into play as users\, their data\, and technology providers can all reside in different physical locations. In fact\, government and industry are grappling with these issues on many fronts – in diplomatic discussions between the U.S. and Europe\, in legislation introduced in the U.S. Senate\, and\, most recently\, in a legal case brought by Microsoft Corp. challenging a US government search warrant for customer communications stored in a company datacenter in Dublin\, Ireland. Prior to joining the National Security Staff\, Mrs. Moore worked as the Senior Information Technology (IT) and Cybersecurity Advisor at the Department of Energy (DOE)\, focused on cybersecurity for the Energy Sector and managing public-private partnerships. She also played a key role in IT and cybersecurity governance for the DOE. While at DOE\, Mrs. Moore led the development of the Electricity Sector Cybersecurity Capability Maturity Model which is being used both domestically and internationally. Prior to joining the DOE\, Mrs. Moore worked as the Director of the Office of Management and Data Systems for the Occupational Safety and Health Administration\, and for Deloitte Enterprise Risk Services. Mrs. Moore has worked as a consultant\, systems engineer\, and IT manager\, and has performed security assessments\, managed security operations and security planning for government agencies as well as private industry. Mrs. Moore received a bachelor’s degree from Virginia Tech in Accounting and Information Systems and a master’s degree from the George Washington University in Engineering Management Systems Engineering\, where she is currently an adjunct professor. \nJon Boyens\, Senior Advisor\, Computer Security Division\, NIST at U.S. Department of Commerce \nJon Boyens is a Senior Advisor for Information Security in the Information Technology Laboratory\, an organization within the Department of Commerce’s National Institute of Standards and Technology (NIST). He leads NIST’s Information and Communications Technology Supply Chain Risk Management Program and works on multiple policy and technical projects. Jon helps develop and coordinate the Department of Commerce’s cybersecurity policy work among the department’s bureaus and represents the department in the Administration’s interagency cybersecurity policy process. He has worked on various White House led initiatives\, including those pertaining to trusted identities\, botnets\, supply chain and\, most recently\, the Cybersecurity Executive Order and related work on Cybersecurity Incentives and the Cybersecurity Framework. \nBob Kolasky\, Senior Advisor to the Assistant Secretary for Infrastructure Protection at US Department of Homeland Security \nBob Kolasky is currently the Director of the Integrated Task Force for Cyber EO and PPD 21 Implementation. He is an experienced strategist\, planner\, and organizational leader and a published writer and analyst\, with the demonstrated ability to develop solutions to public problems.  He previously served as the Director of Strategy and Policy for the DHS Office of Infrastructure Protection.  In that role\, he led strategic initiatives on behalf of the Assistant Secretary to help IP achieve organizational priorities\, including IP’s activities to enhance its capabilities to integrate cyber and physical risk management efforts with critical infrastructure owners and operators\, and approach to improve infrastructure resilience in the face of climate change and other risks.  In addition\, he oversees all aspects of IP’s strategic planning process\, and the related Critical Infrastructure Risk Management Enhancement Initiative.  He also served as IP’s Acting Chief of Staff from August 2012-February 2013 where he was responsible for all aspect of managing the Office of the Assistant Secretary\, and working on behalf of the organization’s leadership to oversee daily operations. \nMr. Kolasky previously served as the Assistant Director for Risk Governance and Support at the in the Office of Risk Management Analysis at the Department of Homeland Security where he focuses on analyzing the risks to the Nation and the degree to which we are focusing our efforts appropriately to manage those risks.  In that role\, he helped facilitate the Department’s Risk Steering Committee\, and is responsible for developing policies and processes to enable risk-informed strategic decisions by DHS.  In addition\, he led the conduct of the first ever Strategic National Risk Assessment\, in partnership with FEMA\, as part of the implementation of Presidential Policy Directive 8. \nNaomi Lefkovitz\, Senior Privacy Policy Advisor\, NIST \nNaomi Lefkovitz is the Senior Privacy Policy Advisor in the Information Technology Lab at the National Institute of Standards and Technology\, U.S. Department of Commerce. Her portfolio includes work on the National Strategy for Trusted Identities in Cyberspace (NSTIC)\, the Consumer Privacy Bill of Rights\, privacy-enhancing technologies\, cybersecurity and standards development. \nFierceGovernmentIT named Ms. Lefkovitz on their 2013 “Fierce15” list of the most forward-thinking people working within government information technology\, and she is a 2014 Federal 100 Awards winner. Before joining NIST\, she was the Director for Privacy and Civil Liberties in the Cybersecurity Directorate of the National Security Staff in the Executive Office of the President.  Her portfolio included the NSTIC as well as addressing the privacy and civil liberties impact of the Obama Administration’s cybersecurity initiatives and programs. Prior to her tenure at the White House\, Ms. Lefkovitz was a senior attorney with the Division of Privacy and Identity Protection at the Federal Trade Commission. Her responsibilities focused primarily on policy matters\, including legislation\, rulemakings\, and business and consumer education in the areas of identity theft\, data security and privacy. \nModerated by: \nMichael H. DESCRIPTION:Cheif Justice (ret.) Dorit Beinisch\, Weistein Family Distinguished Fellow\, is a Senior Fellow at the Center on Law and Security.  Dorit Beinisch served as the President of the Supreme Court of Israel from 2006-2012 and as Justice of the Supreme Court since December 1995.  Before joining the Supreme Court\, Justice Beinisch served in the Israeli Ministry of Justice for 28 years holding different positions in the Criminal Law and Constitutional and Administrative Law divisions.  Her last role in the Ministry of Justice was the State Attorney of Israel in charge of all state litigation in courts. Throughout her public service\, Beinisch represented the state of Israel in major cases before the Supreme Court.  President Beinisch received her legal education (LL.B. and LL.M. summa cum laude) from the Hebrew University of Jerusalem. \nStanley Fischer\, Distinguished Fellow at the Council on Foreign Relations\, is the former governor of the Bank of Israel and a former top official at both the International Monetary Fund and the World Bank. Under Fischer’s leadership as governor of the Bank of Israel\, Israel’s economy grew consistently through most of 2008 and 2009 despite the global economic recession. From 2002 to 2005 Fischer was vice chairman of Citigroup. Fischer served as first deputy managing director of the International Monetary Fund from 1994 to 2001. He was chief economist at the World Bank from 1988 to 1990. Between 1973 and 1994 he taught economics at the Massachusetts Institute of Technology (MIT). Fischer received his bachelor’s and master’s degrees from the London School of Economics and his PhD from MIT. Prior to taking his position at MIT\, Fischer held a faculty appointment at the University of Chicago. He has also held visiting positions at the Hebrew University of Jerusalem and the Hoover Institution at Stanford. \nMoshe Halbertal\, Gruss Professor of Law at NYU School of Law\, is the Professor of Jewish Thought and Philosophy at the Hebrew University\, and a fellow at the Shalom Hartman Institute. He received his Ph.D. from the Hebrew University in 1989\, and from 1988-1992 he was a fellow at the Society of Fellows at Harvard University. Moshe Halbertal served as a visiting Professor at Harvard Law School and the University of Pennsylvania Law School. He is the author of the books Idolatry (co authored with Avishai Margalit) andPeople of the Book: Canon\, Meaning and Authority\, both published by Harvard University Press. He is also the author of Concealment and Revelation: Esotericism in Jewish Tradition and Its Philosophical Implications published by Princeton University Press. His latest book\, Maimonides: Life and Thought provides a comprehensive and accessible introduction to Maimonides’ life and work\, revealing how his philosophical sensibility and outlook informed his interpretation of Jewish tradition. Moshe Halbertal is the recipient of the Bruno Award of the Rothschild foundation\, and the Goren Goldstein award for the best book in Jewish Thought in the years 1997-2000. \nLeon Wieseltier\, Literary Editor at The New Republic\, was educated at Columbia University\, where he studied philosophy\, art history\, and literature; Balliol College\, Oxford\, where he studied philosophy; and Harvard University\, where he studied Jewish history. From 1979 to 1982 he was a member of the Society of Fellows at Harvard University. He is the author of Nuclear War\, Nuclear Peace; Against Identity; and the widely acclaimed Kaddish\, which has been translated into many languages. His many influential essays – on culture\, politics\, and religion; on foreign policy and national security policy; on the Israeli-Palestinian conflict and the Middle East; on humanitarian intervention and contemporary genocide; and other subjects – have been widely published in the United States and abroad. He has also published translations of modern Hebrew poetry. He has been the recipient of numerous fellowships and awards. SUMMARY:CLS Event with Justice Dorit Beinisch & Minister Dan Meridor
DESCRIPTION:The Center on Law and Security was pleased to host President (ret.) Dorit Beinisch\, of the Supreme Court of Israel and Dan Meridor\, a former Justice Minister and Minister of Intelligence and Atomic Energy in Israel on October 24\, 2013. \nJustice Beinisch and Minister. Meridor discussed the system of intelligence oversight in Israel\, and in particular focused on the role of the courts in conducting such oversight.  In this context\, they discussed the role of surveillance in conducting present day military operations\, and the need for strong oversight to create a culture where information gathered by surveillance is secured. The discussion was followed by a conversation that highlighted the importance of defining and understanding privacy in the context of developments in the 21st century. Justice Beinisch is a Fellow at the Center and Law School this Fall.

SUMMARY:Talk on Sanctions & Secrecy in UK National Security Law
DESCRIPTION:The Center on Law and Security was pleased to host Martin Chamberlain and Maya Lester\, two of the UK’s leading human rights lawyers on October 11\, 2013. \nMaya and Martin discussed “Secrecy and Sanctions:  National Security Law in the UK.”  Developments in the British courts regarding sanctions\, drone strikes\, and the ability to protect classified information have had a significant effect not only on British national security law\, but also on the counterterrorism relationship between the US and UK.  Martin and Maya have been at the forefront of much of this litigation and their discussion looked into the state of national security law in the UK.

DESCRIPTION:The Center on Law and Security was pleased to host Thomas Rid\, author of the new book Cyber War Will Not Take Place on September 16\, 2013.  Dr. Rid discussed issues revolving around how best to understand the threat picture in cyber-space\, and whether or not “cyber war” is the best framework.  His book argues that sabotage\, espionage\, and subversion are better ways to understand the predominant cyber-security threats.  Rid offers a new perspective on traditional cyber discussions that will facilitate a more nuanced debate on cyber-security concerns. \nAbout the Speaker\nThomas Rid is a Reader in the War Studies Department at Kings College\, London\, and is one of Europe’s foremost thinkers on issues of cyber-security and conflict\, terrorism\, new technologies and irregular conflict\, and military strategy.

SUMMARY:Political Islam\, the "Arab Spring\," and the Future of Egypt and Syria
DESCRIPTION:In the aftermath of the “Arab Spring” Islamist political parties came to control several Middle East countries\, and important elements of the Syrian opposition.  It is\, nonetheless\, not clear whether or to what extent religious doctrine\, as opposed to secular considerations\, is responsible for their foreign policy choices.  This event will explore the factors that are motivating Islamist political parties in Egypt and Syria\, particularly the Muslim Brotherhood.  It will also explore how the Brotherhood in Egypt has fared since it took power\, and how its sister group in Syria sees a post-Assad future for the country.  It will also consider how the United States should respond to these developments\, and specifically to the ascendance of Islamist political parties in the last several years. \nThe video of this event is available\, click here to watch. \nAhmed al-Rahim (Ph.D.\, Yale University) is a visiting CLS Fellow and an assistant professor at the University of Virginia\, where he teaches Islamic studies in the Department of Religious Studies.  His work centers mainly on the medieval intellectual traditions of Islamic civilization (particularly the transmission of Arabo-Islamic philosophy\, medieval biography\, and virtue ethics).  Dr. al-Rahim is currently working on a monograph\, titled Political Islam: Medieval Theology\, Modern Ideology\, which examines the ways in which elements of medieval Islamic law\, theology\, and history are—often through historical memory—fused with the modern (post-Napoleonic invasion of Egypt in 1798) ideological programs of political Islam; among which are those of modern Salafism\, the Muslim Brotherhood\, political Shi’ism\, and most recently Jihadi-Salafism. \nSteven A. Cook is Hasib J. Sabbagh senior fellow for Middle Eastern studies at the Council on Foreign Relations (CFR).  He is an expert on Arab and Turkish politics as well as U.S.-Middle East policy.  Dr. Cook is the author of The Struggle for Egypt: From Nasser to Tahrir Square (Oxford University Press\, Fall 2011)\, which won the Washington Institute for Near East Policy’s gold medal for best book on the Middle East in 2011\, and Ruling But Not Governing: The Military and Political Development in Egypt\, Algeria\, and Turkey (Johns Hopkins University Press\, 2007). \nMichael Wahid Hanna is a senior fellow at The Century Foundation.  He works on issues of international security\, international law\, and U.S. foreign policy in the broader Middle East and South Asia.  He recently served as a co-director of The Century Foundation’s International Task Force on Afghanistan\, co-chaired by Thomas Pickering and Lakhdar Brahimi.  He has published widely on U.S. foreign policy in newspapers and journals\, including articles in the New York Times\, the Los Angeles Times\, the Boston Globe\, Christian Science Monitor\, the New Republic\, and World Policy Journal\, among other publications\, and is a frequent contributor to Foreign Policy. \nTarek Masoud is an associate professor of public policy at Harvard University’s John F. Kennedy School of Government.  A political scientist and the Middle East specialist\, his research focuses on political development in countries that are poor and unfree.  He is particularly interested in the processes by which governments become more accountable to\, representative of\, and responsive to the needs of their people. He is the author of a forthcoming book on Islamic political parties\, and is the co-editor of Problems and Methods in the Study of Politics (Cambridge\, 2004) and Order\, Conflict\, and Violence (Cambridge\, 2008)\, and his articles and reviews have appeared in the Journal of Democracy\, Middle Eastern Law and Governance\, Foreign Policy\, and the International Journal of Middle East Studies\, among others. \nAndrew J. Tabler is a senior fellow in the Program on Arab Politics at The Washington Institute for Near East Policy\, where he focuses on Syria and U.S. policy in the Levant.  The cofounder and former editor-in-chief of Syria Today\, Syria’s first private-sector English-language magazine.  Mr. Tabler achieved unparalleled long-term access to Bashar al-Asad’s Syria.  During fourteen years of residence in the Middle East\, Mr. Tabler served\, most recently\, as a consultant on U.S.-Syria relations for the International Crisis Group (2008) and as a fellow of the Institute of Current World Affairs (2005-2007)\, writing on Syrian\, Lebanese\, and Middle Eastern affairs.  Upon completion of his graduate studies in 1994\, he obtained editorships with the Middle East Times and Cairo Times; Mr. Tabler became senior editor and director of editorial for the Oxford Business Group (OBG) in 2000.  The following year\, he personally oversaw with OBG the first comprehensive report on Syria in more than thirty years.
