DESCRIPTION:Cybercrime is a business. While some hackers engage in cyberattacks to steal state secrets or to engage in sabotage for political purposes\, a significant portion of the attacks that plague American companies and individuals are motivated by money.  Whether the perpetrators are Eastern European organized crime groups or actors linked to the Chinese military in ways that may be obscure\, the goal is often to turn a profit.  Deterring these actors means not only trying to keep them out of our systems and networks in the first place\, but also making it as difficult as possible for them to raise\, move\, store\, and use funds. Most recently\, innovative and effective sanctions have addressed Iran’s nuclear program and Russia’s aggression in Ukraine\, demonstrating the importance of coercive economic measures to U.S. foreign policy. But as sanctions have become a key piece of the U.S. strategy abroad\, policymakers and thought leaders have raised questions about the role\, effectiveness\, and centrality of sanctions in U.S. policy. \nThis CNAS public conference on U.S. sanctions and national security\, co-hosted with the Center on Law and Security at NYU School of Law\, featured an overview of administration policy on sanctions and a discussion among distinguished former policy leaders on the role for coercive economic measures in tackling the security challenges of the future. The event coincided with the release of a CNAS report on the effects and effectiveness of sanctions since 9/11. Some questions this conference will explore include: how can the United States measure and achieve intended effects from the use of coercive economic measures? Goldman\, Executive Director\, Center of Law and Security\nKatherine J. Strandburg\, Alfred B. Engelberg Professor of Law\n\nMore than ever before\, people today rely on cloud computing services for email\, online storage and backup\, social media\, video services\, and gaming. However\, the laws governing data privacy obligations were written long before anyone dreamed up the cloud. This makes regulatory issues very complicated at the purely domestic level\, but even more so when cross-jurisdictional issues come into play as users\, their data\, and technology providers can all reside in different physical locations. In fact\, government and industry are grappling with these issues on many fronts – in diplomatic discussions between the U.S. and Europe\, in legislation introduced in the U.S. Senate\, and\, most recently\, in a legal case brought by Microsoft Corp. challenging a US government search warrant for customer communications stored in a company datacenter in Dublin\, Ireland. With sectarian tensions high\, the Iranian role in Iraq is coming under renewed scrutiny at the same time as Iran and the P5+1 are negotiating over its nuclear program. Energy prices are at multi-year lows\, enhancing the leverage generated by robust sanctions\, and increasing—if marginally—the chances for a comprehensive agreement. What will the security environment of the Gulf look like over the next year? What role can the U.S. government play in the security architecture of the region\, working with its allies to protect against both the terrorism threat and regional adversaries? Prior to joining the National Security Staff\, Mrs. Moore worked as the Senior Information Technology (IT) and Cybersecurity Advisor at the Department of Energy (DOE)\, focused on cybersecurity for the Energy Sector and managing public-private partnerships. She also played a key role in IT and cybersecurity governance for the DOE. While at DOE\, Mrs. Moore led the development of the Electricity Sector Cybersecurity Capability Maturity Model which is being used both domestically and internationally. Prior to joining the DOE\, Mrs. Moore worked as the Director of the Office of Management and Data Systems for the Occupational Safety and Health Administration\, and for Deloitte Enterprise Risk Services. Mrs. Moore has worked as a consultant\, systems engineer\, and IT manager\, and has performed security assessments\, managed security operations and security planning for government agencies as well as private industry. Mrs. Moore received a bachelor’s degree from Virginia Tech in Accounting and Information Systems and a master’s degree from the George Washington University in Engineering Management Systems Engineering\, where she is currently an adjunct professor. \nJon Boyens\, Senior Advisor\, Computer Security Division\, NIST at U.S. Department of Commerce \nJon Boyens is a Senior Advisor for Information Security in the Information Technology Laboratory\, an organization within the Department of Commerce’s National Institute of Standards and Technology (NIST). He leads NIST’s Information and Communications Technology Supply Chain Risk Management Program and works on multiple policy and technical projects. Jon helps develop and coordinate the Department of Commerce’s cybersecurity policy work among the department’s bureaus and represents the department in the Administration’s interagency cybersecurity policy process. He has worked on various White House led initiatives\, including those pertaining to trusted identities\, botnets\, supply chain and\, most recently\, the Cybersecurity Executive Order and related work on Cybersecurity Incentives and the Cybersecurity Framework. \nBob Kolasky\, Senior Advisor to the Assistant Secretary for Infrastructure Protection at US Department of Homeland Security \nBob Kolasky is currently the Director of the Integrated Task Force for Cyber EO and PPD 21 Implementation. He is an experienced strategist\, planner\, and organizational leader and a published writer and analyst\, with the demonstrated ability to develop solutions to public problems.  He previously served as the Director of Strategy and Policy for the DHS Office of Infrastructure Protection.  In that role\, he led strategic initiatives on behalf of the Assistant Secretary to help IP achieve organizational priorities\, including IP’s activities to enhance its capabilities to integrate cyber and physical risk management efforts with critical infrastructure owners and operators\, and approach to improve infrastructure resilience in the face of climate change and other risks.  In addition\, he oversees all aspects of IP’s strategic planning process\, and the related Critical Infrastructure Risk Management Enhancement Initiative.  He also served as IP’s Acting Chief of Staff from August 2012-February 2013 where he was responsible for all aspect of managing the Office of the Assistant Secretary\, and working on behalf of the organization’s leadership to oversee daily operations. \nMr. Kolasky previously served as the Assistant Director for Risk Governance and Support at the in the Office of Risk Management Analysis at the Department of Homeland Security where he focuses on analyzing the risks to the Nation and the degree to which we are focusing our efforts appropriately to manage those risks.  In that role\, he helped facilitate the Department’s Risk Steering Committee\, and is responsible for developing policies and processes to enable risk-informed strategic decisions by DHS.  In addition\, he led the conduct of the first ever Strategic National Risk Assessment\, in partnership with FEMA\, as part of the implementation of Presidential Policy Directive 8. \nNaomi Lefkovitz\, Senior Privacy Policy Advisor\, NIST \nNaomi Lefkovitz is the Senior Privacy Policy Advisor in the Information Technology Lab at the National Institute of Standards and Technology\, U.S. Department of Commerce. Before joining NIST\, she was the Director for Privacy and Civil Liberties in the Cybersecurity Directorate of the National Security Staff in the Executive Office of the President.  Her portfolio included the NSTIC as well as addressing the privacy and civil liberties impact of the Obama Administration’s cybersecurity initiatives and programs. Prior to her tenure at the White House\, Ms. Lefkovitz was a senior attorney with the Division of Privacy and Identity Protection at the Federal Trade Commission. Her responsibilities focused primarily on policy matters\, including legislation\, rulemakings\, and business and consumer education in the areas of identity theft\, data security and privacy. \nModerated by: \nMichael H. Michael also works closely with ABB\, Harris\, Honeywell\, Schneider Electric\, Rockwell\, and Yokogawa – companies that use the NextNine software in thousands of utilities\, ONG\, mining\, marine\, public infrastructure\, emergency services\, pharma\, food and beverage\, and other critical infrastructure sites around the globe. Michael also serves as the Vice President and Program Chair for the NY Section of the ISA – International Society of Automation. \nMichael has authored 16 patents on secure fiber optic devices\, network equipment\, and secure data protocols.  He has published numerous papers\, and “The Fiber Optic LAN Handbook” with 100\,000 copies in print.  He has won several industry awards\, and is an (ISC)2 Certified Information Systems Security Professional (CISSP). Michael has a Bachelors Degree in Electrical Engineering from MIT\, a Masters Degree in Business from Columbia University\, and a Masters Degree in Mathematics from the Courant Institute of Mathematical Sciences at New York University.

DESCRIPTION:CDR Michael Adams\, Deputy Legal Counsel of the Office of the Chairman of the Joint Chiefs of Staff\, joined the Center on Law and Security for a morning discussion on March 6th. \nCDR Adams discussed “Jus extra bello\,” the evolving legal and other rules that govern when states can use force\, particularly against terrorist groups\, outside of zones of active hostility.  This issue will become particularly important as the U.S. winds down its presence in Afghanistan later this year\, and as al-Qaida affiliated groups outside of South Asia continue to grow in strength.
