SUMMARY:New Terrorism Threats and Counterterrorism Strategies
DESCRIPTION:In the post-9/11 era\, the international community has made significant progress in the struggle against terrorism. However\, in the last several years\, terrorist groups\, notably ISIS\, have innovated both in their operational tactics and strategic aims\, as well as in their methods of fundraising. \nThis conference\, on new terrorism threats and counterterrorism strategies\, co-hosted with the Center for a New American Security\, will feature an overview of the strategic terrorism threat landscape and of the Trump administration’s counterterrorism strategies. Most recently\, innovative and effective sanctions have addressed Iran’s nuclear program and Russia’s aggression in Ukraine\, demonstrating the importance of coercive economic measures to U.S. foreign policy. But as sanctions have become a key piece of the U.S. strategy abroad\, policymakers and thought leaders have raised questions about the role\, effectiveness\, and centrality of sanctions in U.S. policy. \nThis CNAS public conference on U.S. sanctions and national security\, co-hosted with the Center on Law and Security at NYU School of Law\, featured an overview of administration policy on sanctions and a discussion among distinguished former policy leaders on the role for coercive economic measures in tackling the security challenges of the future. The event coincided with the release of a CNAS report on the effects and effectiveness of sanctions since 9/11. Some questions this conference will explore include: how can the United States measure and achieve intended effects from the use of coercive economic measures? Under a potential deal\, Iran would put significant limitations on its nuclear program in exchange for sanctions relief from the international community. But the detail and effects of any potential agreement are far from simple. Iran’s regional rivals\, who are core U.S. partners in the Middle East\, are deeply concerned about how a deal will change regional power dynamics. There are also questions about economic competition\, particularly in energy markets in the aftermath of a nuclear deal. And there are many questions about how the United States and the European Union would be able to re-impose their punishing economic sanctions in the event that Iran does not adhere to a deal. Engelberg Professor of Law\n\nMore than ever before\, people today rely on cloud computing services for email\, online storage and backup\, social media\, video services\, and gaming. However\, the laws governing data privacy obligations were written long before anyone dreamed up the cloud. This makes regulatory issues very complicated at the purely domestic level\, but even more so when cross-jurisdictional issues come into play as users\, their data\, and technology providers can all reside in different physical locations. In fact\, government and industry are grappling with these issues on many fronts – in diplomatic discussions between the U.S. and Europe\, in legislation introduced in the U.S. Senate\, and\, most recently\, in a legal case brought by Microsoft Corp. challenging a US government search warrant for customer communications stored in a company datacenter in Dublin\, Ireland. Dorit Beinisch\, Weinstein Family Distinguished Fellow at the Center on Law and Security and former Chief Justice of Israel;\nRajesh De\, General Counsel of the National Security Agency;\nThe Honorable Jane Harman\, Director\, President & CEO of the Woodrow Wilson International Center for Scholars and former member of the House Intelligence Committee.\n\nModerated by: \n\nProfessor Samuel Rascoff\, Associate Professor of Law and Faculty Director of the Center on Law and Security.\n\nIn the last year\, as attention to surveillance issues has expanded dramatically\, questions have been raised about the structure and function of the institutions in the United States that are engaged in oversight of the intelligence agencies.  These questions are part of a larger dialogue about the post-9/11 expansion in the intelligence and counterterrorism enterprise\, and will be informed by a comparative analysis of the ways in which intelligence agencies are overseen outside the United States\, specifically engaging in a discussion about the role of the Supreme Court of Israel in overseeing intelligence services in that country.\n\n1.5 New York CLE credits for newly admitted and experienced attorneys.
